Booking Conditions
Please read through the following terms & conditions carefully. It is the responsibility of the person making the booking (the party leader) to ensure that every member of the party has read and fully understood all the booking conditions.
The booking conditions as below apply to all booking
made through Holidays in Newquay (incorporating Diamond Holidays Rentals).
The Contract
1a. The contact entered into is between the (establishment) (the
proprietor) and the person completing the booking form
(the hirer).
1b. The rental agreement is made on the basis that the accommodation is to
be occupied by the Tenant (hirer) for a holiday as mentioned in the Housing
Act 1988 Schedule 1 paragraph 9 and the tenants acknowledges that the
tenancy granted by this is not an assured tenancy and that no statutory
periodic tenancy will arise when it ends.
1c. The contract is not effective until the required payment has been
received and confirmation of the booking from the owner to the hirer has
been sent.
Bookings
2a. Bookings can not be made by anyone under the age of 18years. We accept no
bookings for anyone under the age of 16years at the time of the holiday. (eg
all party members must be over 16 years old by the start date of the
holidays unless travelling with parent or legal guardian.)
2b. The number of person occupying a property must not excess the number
booked / named by the booking person on the booking form and also the
maximum stated in the current property description.
2c. The person making the booking will be responsible for all persons
included on the booking form and should ensure that they are all aware of
the booking conditions.
2d. The owner (employee) reserve the right to decline any booking or
refuse to hand over a key to any person who has not complied with the
booking conditions.
Reservations
3c. To secure a reservation: complete all parts of the booking form.
Print out as your copy and submit a copy to us.
3d. We require a deposit of a minimum of 25% of the cost of the
accommodation.
3e. To pay balance of the cost of the holiday not later than six weeks
before the holiday is due to start.
Late payments will occur an £10.00 administration charge.
3f. Bookings made less than six weeks before the start date are required
to pay the full accommodation cost when booking.
3g. All deposit are non refundable and non transferable, Deposits will be
returned if the booking can not be accepted for any reason. We recommend that
personal holiday insurance is taken out to cover any cancellations.
3h. All bookings carry a £5.00 booking fee.
Security Deposit
(3i) We reserve the right to request a credit card pre-authorisation
(‘pre-auth’) on arrival to act as a security deposit during your stay. The
total amount required will be confirmed on your booking confirmation. We
will also accept on arrival for anyone without a credit card payment by cash
or debit card on arrival. (please note no keys will be handed out until
security bond payment has been received.)
(3j) The pre-authorisation process will not debit your account but the funds
will be held for us by your card issuer until such time as we instruct a
cancellation. The pre-authorised amount will therefore be made unavailable
to you during your stay. We can only accept one pre-auth per booking.
(3k) Whilst Visa Credit and MasterCard are the preferred form of pre-auth,
we will accept payment from Visa Debit, and Delta, Visa
Electron, Maestro/Switch, Solo, or cash as a form of deposit on arrival.
(3l) The pre-auth covers damage within your booked accommodation(s) and to
Accommodation property (including all bed linen), smoking (within your
booked accommodation(s) and elsewhere in the Buildings), and disruptive
behaviour. Whilst staying at Eton Court we kindly ask that you respect your
fellow guests, Accommodation staff, Accommodation property, and all 3rd
parties. We pay particular attention to noise and do expect noise to be kept
to a reasonable level after 10pm. Naturally, we want you to have an
enjoyable stay, however, this cannot be at the expense of other guests or
staff.
(3m) The pre-auth is released ten working days after authorisation has been
given unless otherwise stated after all Accommodations have been checked and once every member of the
party has vacated. We recommend that the Party Leader accompanies the member
of staff during an inspection to avoid any possible dispute after departure.
Please be aware that your card issuer may take several days to make the
funds available to you after the release.
Cancellations
4a. Once a booking has been confirmed the hirer is responsible for the
remaining cost of the holiday.
4b. In the event of a cancellation by the hirer the owner (employee) will
endeavour to re-let the property and if successful may refund any monies
paid less the deposit which is non refundable.
Booking Alterations
5a. Any changes to dates or properties will be subject to
availability and
agreement by the owner and a £10.00 administration charge.
5b. Any changes to the original booking details must be informed to the
office immediately.
5c. Any changes to the booking person details may result in the booking
being treated as a cancellation.
5d. Any name changes to the original booking will be subject to a £5.00
charge per name change. All names changes have to be informed to the owner
(employees) no later that 14days before arrival.
5e. In the event of the accommodation becoming unavailable. We will
endeavour to provide alternative accommodation or refund all monies paid or
a proportion in the case of curtailment.
We reserve the right to move you to an alternative accommodation if
necessary within Eton Court.
Damage, Loss and Nuisance
6a. The hirer agrees:
Not to cause nuisance or annoyance to occupants of nearby properties.
To allow reasonable access to the property by the owner (employee) if it is
deemed necessary, any time day or night.
To pay for any damage or loss however caused, excluding reasonable wear.
Loss of security keys are charged at £50.00 per key lost.
Not to bring illegal substance in to the accommodation or grounds and to
smoke within the accommodations.
Under 18years are not permitted to bring alcohol into the accommodation or
grounds. any under 18years caught with alcohol will be asked to leave
immediately.
Not to entertain anyone that is not named on there booking form.
To keep all the bedding on the beds and in the bedrooms.
The hirer / party leader is reasonable for leaving the accommodation in good
order and clean condition; otherwise a cleaning charge will be levied.
6b. If in the opinion of the owner (employee) any person is not suitable
to continue their occupation of the property because of unreasonable
behaviour, damage or nuisance to other parties, the contract may be
discharged and the owner (employee) may repossess the property immediately.
The hirer will remain liable for the whole cost of hire and no refund shall
be due.
Occupancy
7a. Occupancy shall be from 4pm on the arrival day
by prior arrangement with our arrival team at least 7 days before arrival.
Proof of ID will be required for key collection, along with the latest copy
of your confirmation letter.
7b. Departure is by 0930am.
7c. Do not ask for an earlier arrival time as you may be offended when
refused.
7d. We have a wheel clamping firm patrolling our car park, so
unless you have check in and have been issued your parking permit please don’t leave
you car in the car park. Please park in the bay number that matches
your accommodation booked.
7e. Electric is by card meter in either £5 or £10 card, these can be
pre-paid for when booking / paying your balance. Extra electrical can be
purchased during your stay.
7f. Excessive usage of gas, water will be charged for. (this charge could be
taken out of your bond).
7g. Heating is available at an extra charge of £2.50 per day. ( set up to
for a total of 3 hrs and 15 mins from 4pm to 9am in 15 minute bursts to keep
the accommodation warm )
Description
8a. Whilst the owner (employee) makes every effort to ensure that the
accuracy of property descriptions, descriptions are inevitably subjective
and are for guidance only. If there are any points of particular importance
please contact the owner (employee) to clarify information.
8b. Whilst the owner (employee) has taken all responsible steps to ensure
that the information contained in its brochures, tariffs, leaflets. Website
and advertisement are accurate the owner (employee) reserve the right to
alter, substitute or withdraw any service, facilities or amenity.
Liability
9a. The owner (employee) cannot accept responsibility for any material
loss, personal injury, damage, additional expense or inconvenience directly
or indirectly caused by or arising out of the property and its, plumbing,
gas, electrical or otherwise, exceptional weather or other matters over
which we have no control.
9b. No responsibility is accepted for loss or damage of property vehicles
or vehicle contents belonging to hirer or any member of the party during
their occupancy.
Pets
10a. Pets are not permitted unless permission in writing is given by
the office.
Complaints
11a. If in the opinion of the hirer there are grounds for
complaint, it is the duty of the hirer to take it up with the owner or
employee immediately and in any event before departure to allow remedial
action to be taken.
11b. It is specifically agreed that failure by the hirer to notify the
owner (employee) of any compliant in accordance with the timescale set out
above will entitle the owner (employee) to refuse to entertain the
complaint, irrespective of its merits.
12. No bookings will be accepted unless our terms set out here are agreed to
when filling in our on-line booking form.
Any member found breaking any of the terms set out may be asked to leave the
accommodation & may also lose their security bond depending each individual
case,
12.a We reserve the right to make changes to out terms set out at any time
without any notice being given.
Date Protection
The Owner (employee) will retain your personal information which you
provide on your enquiry or booking form. This information will not be
passed on to any 3rd parties, other than when required by law.
